Definitions

Meaning of terms used in this Terms and Conditions:

1. Client - a natural person, a legal person or an organizational unit that is not a legal person, to which special regulations grant legal capacity, who places an order at Store;

2. Consumer - in accordance with art. 22 [1] of the Civil Code means a natural person making a legal transaction with an entrepreneur not directly related to its business or professional activity.

3. Civil Code - the Act of April 23, 1964 (Polish Journal of Laws No. 16, item 93, as amended);

4. Terms and Conditions - these Terms and Conditions are defining the general terms and conditions of sale and rules for providing electronic services available through the Vitesi online store;

5. Online store (Store) - an internet service available at www.sklep.vitesi.com, through which the customer may place Orders;

6. Product, item - product presented in the Online Store;

7. Sales contract - a contract for the sale of Products within the meaning of the Civil Code, concluded between „MB CONSULTING" MACIEJ BRATEK and the Customer, through the website service;

8. Consumer Rights Act - Act of 30 May 2014 on consumer rights (Polish Journal of Laws of 2014, item 827);

9. The Act on the provision of electronic services - the Act of 18 July 2002 on the provision of electronic services (Polish Journal of Laws No. 144, item 1204, as amended.);

10. Order - Customer's declaration of will, aimed directly at the conclusion of the Sales Agreement, specifying the type and quantity of the Products.

General provisions

1. These Terms and Conditions define the rules for using the online store available at  www.sklep.vitesi.com

2. These Terms and Conditions are the terms and conditions referred to in art. 8 of the Act on the provision of electronic services.

3. The www.sklep.vitesi.com online store is run by „MB CONSULTING" MACIEJ BRATEK ul. Dowborczyków 10, lok. 21, 90-019 Łódź, NIP[tax identification number] :7282567571, REGON [business entity identification number]: 100796450 7282687536

4. These Terms and Conditions specify in particular:

    • rules for registering and using an account within an online store;

    • terms and conditions for submitting Orders by electronic means through the online store;

    • principles of concluding Sales Agreements with the use of services provided within the Online Store.

5. Using the online store is possible if the following minimum technical requirements are met by the Customer’s ICT system: Making purchases through www.sklep.vitesi.com  requires the acceptance of cookies by the user's browser. The website works on a properly configured Internet Explorer, Mozilla Firefox, Google Chrome or other updated and properly configured browser.

6. In order to use the online store Customer should get his/her own access to the computer 

7. Customers can access these Terms and Conditions at any time through the link found on the home page of www.sklep.vitesi.com download it and print it.

Rules of using the Online Store

1. Registration at the Online Store is optional. The Customer may place an order without registering at the Store, after reading and accepting these Terms and Conditions.

Registration takes place by completing and accepting the registration form, available on one of the Store website’s pages.

The condition of registration is to agree to the content of the Terms and Conditions and to provide personal data marked as mandatory.

Vitesi may deprive the Customer of the right to use the Online Store, as well as limit its access to some or all of the Online Store's resources, with immediate effect, if the Customer violates the Terms and Conditions, in particular when the Customer:

    • provided during registration in the online store the data that is false, inaccurate or out-of-date, misleading or violating the rights of third parties,

    • committed an infringement of personal rights of third parties through the online store, in particular the personal rights of other customers of the online store,

    • performs other actions that Vitesi considers non-compliant with the abiding law or general terms of using Internet or harmful to the good reputation of Vitesi

A person who has been deprived of the right to use the online store cannot re-register without the prior consent of Vitesi

2. To ensure the security of the transmission of messages and data related to the services provided through the Website, the Online Store takes technical and organizational measures appropriate to the degree of risk posed to the safety of provided services, in particular measures to prevent the unauthorized collection and modification of personal data sent on the Internet.

3. The Customer is obliged in particular to:

    • use the Online Store in accordance with the provisions of the applicable law on the territory of the Republic of  Poland, with the provisions of the Terms and Conditions, as well as with the general principles of using the Internet.

    • not provide ant to not transmit the contents prohibited by law, e.g. content that promotes violence, defamatory or violates personal rights and other rights of third parties,

    • use the Online Store in a way that does not have a distorting effect on its functioning, in particular through the use of specific software or devices,

    • not take actions such as: sending or placing unsolicited commercial information (spam) as part of the Online Store

    • use the Online Store in a way that is not harmful to other clients and for Vitesi

    • use any content posted on the Online Store only for personal use.

Procedure related to conclusion of the Sales Agreement

1. In order to conclude a Sales Agreement through the Online Store, please visit the website www.sklep.vitesi.com and select the Product taking further technical steps based on the messages displayed to the Customer and the information available on the website.

2. The choice of Products ordered by the customer is made by adding them to the basket.

3. During placing the Order - before pressing the button confirming the Order placement - the Customer has the possibility to modify the entered data and the selected Product. To do this, the Customer should follow the messages displayed for him/her and the information available on the website.

4. A summary of the placed Order will be displayed, after providing by Customer all necessary data through the Online Store. The summary of the placed Order will include, among others description of selected product or services, total price and all other costs.

5. To submit your Order, you need to accept the Terms and Conditions, submit your personal data marked as obligatory and press the bottom confirming your Order.

6. Information about the Products provided on the Store's websites constitutes an offer within the meaning of art. 66 of the Civil Code. Submitting the Order by the Customer shall constitute a declaration of will of entering into a sales agreement with Vitesi in accordance with the Terms and Conditions. The agreement is considered concluded at the moment in which the Online Store's IT system obtains the confirmation of Customer's order, subject to compliance of Order with the Terms and Conditions. After concluding the agreement, the Customer receives an e-mail confirming all essential elements of the Order.

7. The sales agreement is concluded in English, with the content in accordance with the Terms and Conditions.

8. Customers can access these Terms and Conditions at any time through the link found on the home page of www.sklep.vitesi.com, download it and print it.

Delivery

1. We deliver the ordered products via courier. It is not possible to personally pick up the ordered products in our store.

2. Delivery costs are set individually for each order.  For orders over 150 Euro - FREE shipping

3. Deadline for the realisation of the order is up to 2 business days and counts from the day of placing the Order by the Customer. The delivery deadline is 4-5 business days and counts from the date of shipment.

4. Damage to the Product caused during delivery.

In the case of consumer distance purchase, our Store always bears the risk of accidental damage or loss of the product in transport. If the products are delivered with obvious damage during transport, we kindly ask you to report such defect to the deliverer and contact us as soon as possible. The delay in submission of such complaints or in taking contact with us has no consequences for your statutory rights and their satisfaction, in particular for your rights under statutory warranty for defects (point VIII of the Terms and Conditions). Faster notification of noticed damage during transport will be for us helpful in the assertion of our own claims against the carrier or transport insurance company.

In the case of a Customer who is not a Consumer: the risk of accidental damage or loss of the Product passes from the Online Store to the buyer at the time when the Product is delivered to the carrier involved in the carriage of items of this type or to the person or courier company designated by the buyer.

 Prices and payment methods

Orders in the store can be paid by traditional transfer - payment at any time, not exceeding 7 days from the date of order. After the payment is credited to our account we will begin processing your order.  If you exceed the period of 7 days, the order will be cancelled.

REMEMBER!

1. The product destined for exchange must be full value, i.e. without any signs of use, without any odours, e.g. perfumes or creams, without damage and with all tags and labels. 

Damaged, incomplete or dirty item is not refundable or exchangeable and will be sent back to you at your expense.

2. Before sending the product for exchange, please check the availability of a new product on our online store.

3. If the product is available, contact us to make a reservation

4. You can exchange the product for a new one at the same price, lower or higher.

5. If you exchange the product for a cheaper one, we will return you the difference to the bank account indicated in the exchange form.

6. If you exchange the product for a more expensive one, then you pay the outstanding amount to the Seller's bank account

7. If you exchange the product for the same model, the product will be exchanged with the price at which it was purchased.

8. Free shipping of exchanged product is applied only to parcels to be delivered in the territory of Poland.

RETURNS

If the ordered product turned out to be unsuitable, you can withdraw from the agreement within 14 days without giving a reason.

REMEMBER!

1. The deadline to withdraw from the agreement expires after 14 days from the date on which you came into possession of the item or in which a third party other than the carrier and indicated by you came into possession of the item.

To keep the deadline of withdraw from the agreement, it is sufficient to send the information before the deadline for withdrawal.

2. Returned product must be full value, i.e. without any signs of use, without any odours, e.g. perfumes or creams, without damage and with all tags and labels. The Consumer is responsible for reducing the value of the product, resulting from using it in a different way than was necessary to establish the nature, characteristics and functioning of the product.

Damaged, incomplete or dirty item is not refundable or exchangeable and will be sent back to you at your expense.

3. When you return all products purchased in a specified order, we will refund all payments received from you: the purchase cost of products + shipping costs, excluding the costs of delivering the products to us. If you want to return only part of the order, the shipping costs will not be refund.

COMPLAINTS

All complaints are dealt with in accordance with the provisions of the Act of 23 April 1964. Polish Civil Code.

The seller is responsible for the nonconformity of consumer product with the agreement if it is found within two years from the date of the delivery of this product to the Buyer. The warranty does not cover damage caused, for example, as a result of improper use of the product, or by failure to follow the instructions on the care label wash.

REMEMBER!

You must include a description of the problem in the complaint form.

The shipment of product is at your expense, however, if the complaint is accepted, we will refund you the amount for shipping. 

Seller www.sklep.vitesi.com examine the complaint and provide answer to the Buyer promptly and not later than within 14 days from the date of receipt of product. 

Discount codes, promotions

 1. All promotions (including Discount Codes) related to www.sklep.vitesi.com may not be used in conjunction with any other promotion. The Customer may use only one promotion, unless the terms of the promotion clearly give the possibility of using several promotions together.

 2. All promotions (including Discount Codes) related to www.sklep.vitesi.com do not apply to products in II category, unless the terms of the promotion expressly give such a possibility.

3. In the case of Discount Codes, one person may use the received Discount Code only once, unless the possibility of re-using the promotion multiple times is clearly indicated in its separate regulations.

Complaints about the services provided by electronic means

1. Vitesi takes measures to ensure the proper functioning of the Online Store, to the extent that results from current technical knowledge and undertakes to remove within a reasonable time any irregularities reported by customers.

2. The customer may inform us of any irregularities or interruptions in the functioning of the Online Store. Irregularities related to the functioning of the Store should be reported electronically to the following address:  sklep@vitesi.com 

3. In complaints regarding irregularities related to the functioning of the Online Store, please indicate the type and date of detection of the irregularity.

4. We undertake to respond to the complaint promptly, no later than within 14 days from the date of its submission.

Out-of-court ways to handle complaints and redress

1. Please be informed about the possibility to use out-of-court ways to deal with complaints and redress. Making use of them is voluntary and can only take place if both parties of the dispute agree.

- The Consumer may request the initiation of proceedings related to the out-of-court resolution of consumer disputes regarding concluded Sales Agreement to the Trade Inspection, in accordance with art. 36 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws 2001 No. 4, item 25, as amended).

- The European Commission also provides a platform for online dispute resolution between Consumers and Entrepreneurs (ODR platform). This platform is available at: http://ec.europa.eu/consumers/odr/

2. Detailed information on the settlement of consumer disputes, including the Consumer's possibility of out-of-court complaint handling, on redress and on access to these procedures are available at the headquarters and on the websites of the provincial inspectorates of the Trade Inspection and on the website:https://uokik.gov.pl/spory_konsumenckie.php.

Final terms

1. The competent court for resolving disputes with Consumers shall be the court proper for the location, in accordance with the regulations of the Code of Civil Procedure

2. The settlement of any disputes arising between Vitesi and the Customer who is not a Consumer is subject to a court having jurisdiction over our company’s registered office.

3. In matters not covered by these Terms and Conditions, the provisions of applicable law shall apply, in particular the provisions of the Act of 23 April 1964. Civil Code (consolidated text Polish Journal of Laws from 2014, item 121 as amended) and the act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827). In the case of any inconsistency of these Terms and Conditions with the rights of Customers and provisions resulting from generally applicable provisions, generally applicable provisions of Polish law apply.
